1. INTRODUCTION AND PURPOSE
Welcome to **Gulf Return managed By Sheruh**! These Community Guidelines ("Guidelines") establish the standards of conduct expected from all users of our job and social networking platform. These Guidelines are designed to foster a professional, safe, inclusive, and legally compliant environment for job seekers, employers, recruiters, and professionals. By accessing or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Guidelines, which form an integral part of our Terms of Service www.gulfreturn.com. These Guidelines are formulated in accordance with and in compliance with applicable Indian laws, including but not limited to:
- The Information Technology Act, 2000 and Rules thereunder
- The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended)
- The Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025
- The Indian Penal Code, 1860 / Bharatiya Nyaya Sanhita, 2023
- The Copyright Act, 1957 and Trademarks Act, 1999
- The Equal Remuneration Act, 1976
- The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013
- The Rights of Persons with Disabilities Act, 2016
- The Transgender Persons (Protection of Rights) Act, 2019
- And other applicable laws and regulations as may be in force from time to time.
2. ELIGIBILITY AND ACCOUNT REQUIREMENTS
2.1 Age Requirements
Users must be at least eighteen (18) years of age to create an account and use this platform. In accordance with the Digital Personal Data Protection Act, 2023, we do not knowingly collect or process personal data of individuals below the age of eighteen years. By creating an account, you represent and warrant that you meet this age requirement.
2.2 Account Accuracy and Verification
Users are required to:
- Provide accurate, current, and complete information during registration and maintain the accuracy of such information
- Use their real name and authentic professional identity
- Not create multiple accounts for the same individual or entity
- Not impersonate another person or entity or misrepresent affiliation with any person or entity
- Maintain the confidentiality of account credentials and notify us immediately of any unauthorized access
2.3 Consent Requirements
In compliance with the Digital Personal Data Protection Act, 2023, your consent for data processing must be free, specific, informed, unconditional, and unambiguous. You may withdraw your consent at any time through your account settings. Withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
3. PROHIBITED CONTENT AND CONDUCT
Users shall not host, display, upload, modify, publish, transmit, store, update, or share any information or content that:
3.1 Unlawful and Harmful Content
Do not share Content that:
- Belongs to another person and to which the user does not have any right or authorization
- Is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, including bodily privacy
- Is harmful to minors in any way
- Infringes any patent, trademark, copyright, or other proprietary rights
- Violates any law for the time being in force
- Deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature
- Impersonates another person or entity
- Contains software viruses, malware, or any other computer code designed to interrupt, destroy, or limit the functionality of any computer resource
- Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order
- Incites the commission of any cognizable offence or prevents investigation of any offence
- Is insulting any other nation
- Is patently false and untrue, and is written or published with the intent to mislead or harass
3.2 Harassment and Discrimination
The following conduct is strictly prohibited:
- Sexual harassment, including unwelcome sexual advances, requests for sexual favours, or other verbal or physical conduct of a sexual nature
- Discrimination based on religion, race, caste, sex, place of birth, descent, disability, gender identity, sexual orientation, or any other protected characteristic
- Hate speech or content that promotes enmity between different groups on grounds of religion, race, caste, sex, place of birth, residence, or language
- Bullying, intimidation, stalking, or threats of violence
- Doxxing or sharing private information about others without consent
3.3 Misinformation and Fraud
Do not share Content involving:
- Posting false job listings or fraudulent employment opportunities
- Misrepresenting qualifications, experience, credentials, or professional affiliations
- Engaging in phishing, scams, or any fraudulent schemes
- Spreading false information identified as fake or misleading by authorized fact-check units
- Creating fake reviews, endorsements, or testimonials
3.4 Spam and Commercial Misuse
- Sending unsolicited bulk messages, advertisements, or promotional content
- Using automated systems or bots to access the platform without authorization
- Scraping, data mining, or harvesting user information
- Promoting pyramid schemes, multi-level marketing, or similar business models without proper disclosure
4. EMPLOYMENT AND RECRUITMENT GUIDELINES
4.1 Non-Discrimination in Job Postings
In accordance with constitutional provisions and applicable employment laws, employers shall not discriminate in job postings, hiring, or recruitment processes based on:
- Religion, race, caste, sex, descent, place of birth, or residence
- Gender identity or sexual orientation
- Disability status (as defined under the Rights of Persons with Disabilities Act, 2016)
- Marital status or pregnancy
- HIV/AIDS status
- Age, except where a genuine occupational qualification exists
4.2 Equal Remuneration
Pursuant to the Equal Remuneration Act, 1976, job postings must not discriminate in remuneration offered based on gender. Equal pay must be offered for work of same or similar nature irrespective of gender.
4.3 Job Posting Requirements
Employers posting job opportunities must:
- Provide accurate and complete information about the role, responsibilities, qualifications, and compensation
- Clearly identify themselves or their authorized representative
- Not request fees from job seekers as a condition of employment or consideration
- Not collect sensitive personal data beyond what is reasonably necessary for recruitment
- Comply with all applicable labour and employment laws
4.4 Job Seeker Responsibilities
Job seekers must:
- Provide accurate information regarding qualifications, experience, and credentials
- Not misrepresent educational qualifications, work history, or professional certifications
- Respect confidentiality of recruitment processes and proprietary information shared during applications
- Not engage in fraudulent applications or identity misrepresentation
5. INTELLECTUAL PROPERTY RIGHTS
5.1 Platform Intellectual Property
All content, trademarks, service marks, trade names, logos, and other intellectual property displayed on Gulf Return managed By Sheruh are the exclusive property of Gulf Return managed By Sheruh or its licensors and are protected under the Copyright Act, 1957, the Trademarks Act, 1999, and other applicable intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited.
5.2 User-Generated Content
Users retain ownership of content they create and share on the platform. However, by posting content, users grant the platform a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for the purpose of operating and promoting the platform.
5.3 Third-Party Intellectual Property
Users must respect the intellectual property rights of others and shall not upload, share, or distribute content that infringes copyrights, trademarks, patents, or other proprietary rights of third parties. The platform will respond to valid notices of alleged copyright infringement in accordance with applicable law.
6. PRIVACY AND DATA PROTECTION
6.1 Data Principal Rights
In accordance with the DPDP Act, 2023, Data Principals have the rights listed in this section. We will acknowledge data-subject requests (access, correction, erasure, portability, withdrawal of consent) within seven (7) calendar days. We will ordinarily resolve routine requests within thirty (30) calendar days. Complex requests that require coordination with third-party processors or additional verification may take up to ninety (90) calendar days; in such cases we will notify you of the reason and expected timeline. Where a statutory timeline differs, we will comply with the applicable statutory timeline.
6.2 Data Principal Duties
Users have the following duties under the DPDP Act, 2023:
- Duty to provide accurate and authentic information
- Duty not to impersonate another person while providing personal data
- Duty not to suppress any material information while providing personal data
- Duty not to register false or frivolous grievances or complaints
- Duty to furnish only verifiably authentic information when exercising rights
**Note:** Breach of duties by a Data Principal may result in a penalty of up to Rs. 10,000 as prescribed under the DPDP Act, 2023.
6.3 Data Protection Measures
The platform implements reasonable security safeguards to protect personal data, including encryption, access controls, and regular security assessments. 7. GRIEVANCE REDRESSAL MECHANISM
7.1 Grievance Officer

7.2 Complaint Process and Timelines
- **Acknowledgement:** Within twenty-four (24) hours for content complaints submitted via the in-platform reporting tool or email.
- **Resolution (content moderation):** We will investigate and aim to resolve general content complaints within fifteen (15) calendar days.
- **Expedited removal:** For content involving clear sexual exploitation, private nudity, morphed images, or imminent threat to safety, we will take interim action (removal or restriction) within 24 hours where reasonably practicable.
- **Data-subject (DPDP) requests:** Acknowledged within seven (7) calendar days; routine requests resolved within thirty (30) calendar days; complex requests up to ninety (90) calendar days (see Section 6.1).
We will keep complainants informed of status updates through the reporting mechanism or email.
7.3 Appellate Mechanism
If you are dissatisfied with the resolution provided by our Grievance Officer, you may appeal to the Grievance Appellate Committee established by the Central Government under the IT Rules, 2021, within thirty (30) days of receiving the decision. Additionally, for data protection matters, you may approach the Data Protection Board of India.
8. CONTENT MODERATION AND ENFORCEMENT
8.1 Reporting Violations
Users can report violations of these Guidelines through the in-platform reporting mechanism, by contacting our Grievance Officer, or by email. All reports will be reviewed and addressed in accordance with applicable timelines. When you report a violation please include:
- Link to the profile or job post
- Screenshots or message IDs showing the content
- Date and approximate time of the incident (IST)
- Short description of the issue and any steps you have taken
- Providing evidence speeds up review and helps us take appropriate action.
8.2 Actions Against Violations
Depending on the nature and severity of the violation, we may take one or more of the following actions:
- Issue a warning to the user
- Remove or disable access to the violating content
- Temporarily suspend the user's account
- Permanently terminate the user's account
- Report the matter to law enforcement authorities where required by law
- Retain content and associated records as required under applicable law
8.3 User's Right to Be Heard
Before taking action that removes or disables access to content or terminates an account, we will, where reasonably practicable, provide prior notice to the affected user explaining the grounds for such action and an opportunity to dispute the action. If your content is removed or your account is suspended, you may file an appeal within thirty (30) days. We will acknowledge appeals within seven (7) days and aim to resolve them within fifteen (15) calendar days. Appeals that involve legal or complex verification may take longer; we will notify you if more time is required.
8.4 Government Orders
Upon receiving actual knowledge in the form of a court order or notification from the appropriate Government or its agency, we shall remove or disable access to unlawful content within thirty-six (36) hours from the receipt of such order or notification, or within such shorter timeframe as may be specified.
9. COMPLIANCE AND TRANSPARENCY REPORTS
In accordance with the IT Rules, 2021, we shall publish monthly compliance reports containing details of complaints received and action taken, as well as details of content removed proactively. These reports shall be made available on our website and shall include information regarding the number of complaints received, their nature, actions taken, and timelines for resolution.
10. COOPERATION WITH LAW ENFORCEMENT
We shall cooperate with law enforcement agencies and provide assistance as required under applicable law, including providing information or assistance within seventy-two (72) hours of receipt of a written order from authorized government agencies for verification of identity, prevention, detection, investigation, or prosecution of offences, or for cyber security incidents. User registration information and data shall be retained for a period of one hundred and eighty (180) days after cancellation or withdrawal of registration, or longer as may be required by law. User data will be retained only as required to provide the Services or as required by law. Unless otherwise required, the standard retention approach is:
- **Active account data:** retained while the account is active.
- **Deactivated accounts:** archived for twelve (12) months following deactivation.
- **Job applications and recruitment records:** retained for three (3) years from application date (or longer if required by law).
- **Logs and security metadata:** retained for twenty-four (24) months.
- **Financial/billing records:** retained for eight (8) years as required by tax law.
11. AMENDMENTS AND UPDATES
We reserve the right to modify these Guidelines at any time. We shall notify users of any material changes through the platform interface, email, or other appropriate means at least once annually or when changes are made. Continued use of the platform after such notification constitutes acceptance of the revised Guidelines. Non-compliance with these Guidelines may result in termination of access to the platform.
12. GOVERNING LAW AND JURISDICTION
These Guidelines shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Guidelines shall be subject to the exclusive jurisdiction of the courts at Hyderabad, India.
13. SEVERABILITY
If any provision of these Guidelines is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
